FPIC is a fundamental right that indigenous peoples and other ethnic groups have when measures (legislative and administrative) are taken or when projects, works or activities are to be carried out within their territories. This process seeks to protect cultural, environmental, social and economic integrity, guaranteeing the right to participation. Failure to heed the decision of indigenous peoples implies violating their right to self-determination and their right to autonomy. FPIC is a collective right that must respond to the principle of good faith and must be carried out before the decision is made. It is carried out through a public, special and mandatory process in which due process is guaranteed (principle of opportunity, intercultural communication and bilingualism). It is done prior to the adoption of administrative or legislative measures or the decision on projects that may affect them. The exploitation of natural resources in indigenous territories must be made compatible with the protection that the State must provide to the social, cultural and economic integrity of indigenous communities, integrity that forms a fundamental right… because it is linked to their subsistence as a human group and as a culture. In order to ensure said subsistence, when it comes to exploiting natural resources in indigenous territories, the participation of the community in the decisions adopted to authorize said exploitation has been foreseen.
